Discretionary Trusts on ATO Radar

The ATO have small-practice accountants and lawyers who use discretionary trusts (to try and minimise the tax they pay on their income) on their radar. The Tax Office will review individual cases of professionals operating through partnerships of discretionary trusts, as they are worried that such trusts are being set up to try and avoid paying tax. Individuals are encouraged to talk to their tax advisors, as voluntary disclosures may result in a reduced penalty.
