Charities Act took effect from 1 January 2014
According to the Australian Charities and Not-for-profits Commission (ACNC), recent parliamentary proceedings have confirmed that the Charities Act 2013 would be implemented from 1 January 2014. Editor: The Government amended the Social Services and Other Legislation Amendment Bill 2013 in the House of Representatives, to defer the commencement of the Charities Act 2013 from 1 January 2014 to 1 September 2014, but it failed to be passed by the Senate by 31 December 2013. In addition to defining the legal meaning of “charity”, the Charities Act:
- adds reconciliation, human rights, culture, the environment and more to the list of purposes that are considered charitable;
- recognises that many modern organisations advance causes through education, research and awarenessraising and prevention;
- clarifies the law on charities and native title; and n protects a charity’s right to advocate for policy and lobby on behalf of the groups they benefit.

Ref: ACNC media release 16 December 2013 Extension for 2013 Annual Information Statement Note that the ACNC has also allowed charities with a 1 July to 30 June financial reporting period an extension to the date for submission of their 2013 Annual Information Statement, from 31 December 2013 to 31 March 2014. This approach takes into account that this is the first time many charities have needed to report to the ACNC and that there may be some charities who are not aware of their obligations.
